Goal One’s Mike Walker wins remand, plans appeal
April 5th, 2005 by Jim JustIn a case which challenged Josephine County’s application of its Internal Rate of Return (IRR) system for evaluating forest land, LUBA remanded a county decision rezoning forest land to nonresource land because the county didn’t properly consider non-IRR rated soils. LUBA rejected Walker’s argument that the county’s IRR ratings weren’t the sole determining factor because Goal 4 applies directly to plan amendments. Goal One and Walker are planning to take LUBA’s holding on the Goal 4 issue to the Court of Appeals.
